§ 12613 Produce Seizure Storage

This law lets the owner or caretaker move seized produce to a cold storage warehouse so it doesn't go bad, as long as they follow any hold orders.

Key Takeaways

  • •After produce is seized, the owner can ask to move it to a cold storage warehouse.
  • •The warehouse must be commercial and keep the produce from spoiling.
  • •Any hold orders or notices still apply while the produce is in storage.

Example

A farmer's truck of apples is seized by the state for inspection. The farmer asks to put the apples in a refrigerated warehouse instead of leaving them on the street.

The director can say yes, letting the farmer move the apples to a proper cold storage place, but the farmer still has to obey any hold orders that were issued about the apples.
