§ 10785 Hog Disease Interstate Controls

If the state’s animal health chief thinks new rules are needed to stop certain animal diseases when pigs or hogs are moved between states, they must tell the Governor so the Governor can take action.

Key Takeaways

  • •The secretary can call for extra rules if a disease threat shows up during interstate hog or swine moves.
  • •The secretary must inform the Governor about the need for those rules.
  • •The Governor can then act under another law (Section 9570) to handle the situation.

Example

A farmer wants to ship a herd of pigs from Texas to Ohio and there’s a risk of a new swine disease spreading.

The animal health secretary checks the situation, decides new safety rules are needed, and then notifies the Governor, who can then use other powers to enforce those rules.
