§ 1600 Recorded Property Document Evidence

Key Takeaways

  • •If a paper about who owns something (like a house or car) is officially recorded by the government, it’s usually accepted as real unless someone proves it’s fake.
  • •This rule only works if the government office is allowed by law to keep these kinds of records.
  • •If someone questions the paper, they have to prove it’s wrong—not the other way around.

Example

You buy a house, and the seller gives you a deed (a paper saying the house is yours). The deed is recorded at the county office.

If later someone says the deed is fake, the law says the recorded deed is assumed to be real. The person who says it’s fake has to prove it.
