§ 1241 Hearsay Exception For Conduct

Key Takeaways

  • •If someone says something while doing an action, their words can be used in court to explain why they did it.
  • •This only works if the words help make sense of what the person was doing at that exact time.
  • •The rule doesn’t apply if the words are just repeating what someone else said (hearsay).

Example

A person yells, 'Watch out for the dog!' while pushing someone out of the way.

Their words can be used in court to show why they pushed the person—they were trying to protect them from the dog.
