§ 1026 Psychotherapist Reporting Exceptions

Key Takeaways

  • •Therapists and patients must share info if the law says they have to report it to the government.
  • •If the info is written down in a public record that anyone can see, it’s not private.
  • •This rule only applies when the law says the info must be reported or recorded publicly.

Example

A therapist learns a patient is being hurt by someone at home.

The therapist has to tell the police or a government worker because the law says they must report abuse. Even though therapy is usually private, this info isn’t protected because it’s something that has to be shared to keep people safe.
