§ 1021 Patient Intent Property Documents

Key Takeaways

  • •If someone has died, their doctor or therapist can talk about what the person wanted for their stuff (like money or a house).
  • •This only happens if there’s a fight about who gets the stuff after they die.
  • •The doctor can’t say no to talking about it in court if it’s important for figuring out what the dead person wanted.

Example

A dad dies and leaves a note saying his car goes to his son, but his daughter says the note is fake and she should get the car.

The dad’s doctor can be asked in court if the dad ever talked about who he wanted to have his car. The doctor can’t refuse to answer just because it’s private.
