§ 2143 Election Official Cost Immunity

Key Takeaways

  • •If someone sues the county elections official, they usually can't make them pay money for the lawsuit.
  • •The only way the elections official has to pay is if they did something really bad on purpose, like breaking the rules knowingly.
  • •The person suing has to prove in court that the official did something wrong on purpose.

Example

Someone sues the county elections official because they think their vote wasn't counted fairly.

The official won't have to pay for the lawsuit unless the person can prove the official knew the rules and broke them on purpose.
