§ 19240 Voting Accessibility For Disabilities

This law says California must make voting machines and elections usable for people with disabilities, especially the blind, just like for everyone else.

Key Takeaways

  • •Voting systems must be accessible to voters with disabilities.
  • •Machines need non‑visual options (like audio) for blind or visually impaired voters.
  • •Disabled voters must have the same privacy and independence as other voters.

Example

A blind voter goes to the polling place to cast a ballot.

The voting machine must have spoken instructions and audio feedback so the blind voter can choose candidates and vote privately without needing help, just like a sighted voter.

It is the intent of the Legislature that California voting system standards and elections comply with the provisions of the federal Help America Vote Act of 2002 (52 U.S.C. Sec. 20901 et seq.) that require voting systems be accessible for individuals with disabilities, including nonvisual accessibility for the blind and visually impaired, in a manner that provides the same opportunity for access and participation, including privacy and independence, as provided to other voters who are not disabled. (Amended by Stats. 2015, Ch. 732, Sec. 34. (AB 1536) Effective January 1, 2016.)
