§ 18100 Voter Registration Fraud Penalties

This law makes it a crime to register someone who isn’t allowed to vote, or to sign a fake voter registration for a person who doesn’t exist.

Key Takeaways

  • •Don’t register anyone who isn’t eligible to vote (e.g., a minor, a non‑citizen, or a deceased person).
  • •Don’t sign or send a voter‑registration form for a made‑up person, animal, or object.
  • •If you do either, you could be sentenced to state prison for 16 months to three years, or up to one year in a county jail.

Example

A neighbor helps a friend put the name of a dead relative on the voter list, or signs a form that says a pet is a voter.

Because the person being registered can’t legally vote, the neighbor is breaking the law and could go to prison for up to three years or up to one year in a county jail.
