§ 15104 Vote By Mail Observation

This law lets the public and designated observers watch how mail‑in ballots are handled and counted, and it tells who can observe and how they can check the process.

Key Takeaways

  • •The public and authorized observers can watch the entire mail‑in ballot process, before and after the election.
  • •Observers include members of the grand jury, party central committees, and other interested groups.
  • •Elections officials must give at least 48‑hour notice of when and where ballots will be processed and counted.

Example

A voter who mailed their ballot wants to be sure it’s counted, so a party observer is allowed to stand nearby and watch the counting staff verify the voter’s signature and handle the ballot.

The law says observers can be present from the moment the return envelope is processed until the ballot is counted, and they can check that signatures match and that damaged ballots are copied correctly.
