§ 11384 Recall Vote Successor Qualification

If most people vote "Yes" on a recall, the official being recalled is taken out of the job when the new official officially takes over.

Key Takeaways

  • •A recall works only if a majority of votes are "Yes".
  • •The recalled officer isn’t removed right away; removal happens when the successor is qualified.
  • •Section 11382 has special rules that can change this process.

Example

A town votes to recall its mayor. 55% of voters choose "Yes" on the recall question.

The mayor stays in office only until the new mayor is sworn in and qualified. Once the new mayor is officially in place, the recalled mayor is removed.
