§ 11222 Petition Filing Requirements

This law says a petition has to be turned in all at once, and the elections official counts the signatures to see if there are enough; if there are enough, the petition is accepted, if not, it’s not processed.

Key Takeaways

  • •All parts of a petition must be filed together.
  • •The elections official counts signatures right when the petition is presented.
  • •If the count meets or exceeds the required minimum, the petition is considered filed that day.
  • •If the count is below the minimum, the official does nothing further and the petition is not filed.

Example

A neighborhood group gathers signatures to put a new park measure on the ballot and turns in the petition to the elections office.

The elections official counts the signatures. If the group turned in at least the required number, the petition is accepted that day. If they turned in fewer, the petition is rejected and nothing happens.

How to Calculate

Signatures ≥ MinimumRequired

  1. Count the total number of signatures on the petition.
  2. Find out the minimum number of signatures required for this type of petition.
  3. Compare the counted signatures to the minimum.
  4. If the counted signatures are equal to or greater than the minimum, the petition is accepted; otherwise, it is not accepted.

The group collected 5,200 signatures, and the law says they need at least 4,000 signatures.

Result: Since 5,200 ≥ 4,000, the petition is accepted.

§ 11222 Petition Filing Requirements

(a) The petition shall be filed by the proponents, or by any person or persons authorized, in writing, by a proponent. All sections of the petition shall be filed at the same time. (b) When the petition is presented for filing, the elections official shall determine the total number of signatures affixed to the petition. If, from this examination, the elections official determines that the number of signatures, prima facie, equals or is in excess of the minimum number of signatures required, the elections official shall accept the petition for filing. The petition shall be deemed as filed on that date. A section of the petition not so filed is void for all purposes. If, from the elections official’s examination, the elections official determines that the number of signatures, prima facie, does not equal or exceed the minimum number of signatures required, the official shall not take further action. (Amended by Stats. 2018, Ch. 58, Sec. 12. (AB 3259) Effective January 1, 2019.)
