§ 11101 Signature Presumption Rule

This law says a petition is assumed to have enough valid voter signatures unless an official check shows otherwise.

Key Takeaways

  • •A petition is automatically considered valid when first submitted.
  • •Someone must prove the petition is invalid through an official investigation.
  • •The presumption stays until the investigation shows the signatures are insufficient.

Example

A neighborhood group turns in a petition to put a new park on the city ballot.

The city will treat the petition as having the required number of signatures at first. Only if the city investigates and finds missing or fake signatures will the petition be rejected.
