§ 10734 Special Election Candidate Nomination

This law says you can't hold a separate primary election for a special election; candidates must be nominated the usual way, but with strict timing rules for their paperwork.

Key Takeaways

  • •No special primary election is allowed for a special general election.
  • •Nomination papers can’t be circulated earlier than 46 days before the special election.
  • •Papers must be left with the county elections official at least 39 days before the election.
  • •Papers must be filed with the Secretary of State at least 35 days before the election.

Example

A town needs a special election to replace a council member who resigned.

The town can't run a special primary first. Instead, anyone who wants to run must follow the normal nomination steps, making sure they don't start sending out nomination forms more than 46 days before the election, give the forms to the county elections office at least 39 days before, and file them with the Secretary of State at least 35 days before the election.
