§ 88022 Community College Employment Restrictions

Key Takeaways

  • •You can't work at a community college if you've been convicted of a sex crime or a drug crime.
  • •If your conviction is reversed or charges are dropped, you can work there.
  • •For drug crimes, you might still get the job if the college board thinks you've stayed clean for at least 5 years.
  • •The college board decides if you're rehabilitated, and their decision is final.

Example

John was convicted of selling drugs 6 years ago. He applied for a job as a janitor at a community college.

The college board can hire John if they believe he has stayed away from drugs and is rehabilitated for at least 5 years.

§ 88022 Community College Employment Restrictions

No person shall be employed or retained in employment by a community college district who has been convicted of any sex offense as defined in Section 87010 or controlled substance offense as defined in Section 87011. If, however, any such conviction is reversed and the person is acquitted of the offense in a new trial or the charges against him or her are dismissed, this section does not prohibit his or her employment thereafter. Further, the governing board of a community college district may employ a person convicted of a controlled substance offense if the governing board of the district determines, from the evidence presented, that the person has been rehabilitated for at least five years. The governing board shall determine the type and manner of presentation of the evidence, and the determination of the governing board as to whether or not the person has been rehabilitated is final. (Amended by Stats. 1984, Ch. 1635, Sec. 38.)
