§ 87043 Temporary Disability Check Waiver

Key Takeaways

  • •If a community college worker gets hurt and can't work, they usually get a temporary disability check.
  • •Normally, the worker has to give this check to the college, but the college can let the worker keep it instead.
  • •If the college lets the worker keep the check, the worker still gets their normal pay, minus some deductions like retirement contributions.
  • •The worker's benefits are calculated based on their regular pay, not the disability check amount.

Example

A community college janitor breaks his leg at work and can't work for a month.

The janitor gets a temporary disability check for $2,000. Normally, he would have to give this check to the college, but the college lets him keep it. The college still pays his normal salary of $3,000, but takes out $500 for retirement and other deductions. So, the janitor gets to keep his $2,000 disability check and also gets $2,500 from the college. His benefits are calculated based on his regular $3,000 salary.

§ 87043 Temporary Disability Check Waiver

Notwithstanding the provisions of Sections 87042, 87787 and 88192, a community college district may waive the requirement that temporary disability checks be endorsed payable to the district, and may in lieu thereof, permit the employee to retain his temporary disability check, providing that notice be given to the district that such check has been delivered to the employee. In such cases, the district shall then cause the employee to receive his normal wage or salary less appropriate deductions, including, but not limited to, employee retirement contributions, and an amount equivalent to the face amount of the temporary disability check, which the employee has been permitted to retain. In all cases, employee benefits are to be computed on the basis of the employee’s regular wage or salary prior to the deduction of any amounts for temporary disability payments. Nothing contained herein shall be deemed to in any way diminish those rights and benefits which are granted to a school employee pursuant to the provisions of Sections 87042, 87787 and 88192. (Enacted by Stats. 1976, Ch. 1010.)
