§ 56050 Surrogate Parent Representation Rights

Key Takeaways

  • •A surrogate parent is someone who helps kids with special needs make decisions about their school and health stuff.
  • •They can say 'yes' or 'no' to school plans, therapy, and some medical treatments for the kid.
  • •The state won’t blame the surrogate parent for mistakes unless they did something really bad on purpose.
  • •They have to follow extra rules from another part of California’s laws.

Example

A kid with autism needs a special school plan, but their parents aren’t around.

A surrogate parent can step in to agree to the plan, like extra help in class or speech therapy. If the kid also needs physical therapy, the surrogate parent can sign for that too. The state won’t punish them if they make a normal mistake, but they can’t be careless or mean.
