§ 49071 Pupil Record Hearing Panel

Key Takeaways

  • •If a parent disagrees with something written in their child's school record, they can ask for a special meeting to talk about it.
  • •The meeting group includes a principal from another school, a teacher chosen by the parent or a teacher group, and another parent chosen by the school.
  • •The people in the meeting should not know the child, parent, or teacher involved, unless the parent picks someone they know.
  • •The meeting is private, and what is said there stays there. The group writes down what they decide and sends it to the school boss.

Example

A parent thinks their child's school record says something unfair, like the child was mean to others, but the parent believes it's not true.

The parent can ask the school to set up a private meeting with a principal from another school, a teacher (maybe one the parent picks), and another parent. They will listen to both the parent and the teacher who wrote the note. Then they will decide if the note should stay or be changed. What they talk about in the meeting is kept secret, and they write down their decision to tell the school boss.

(c) The principal appointed to the hearing panel shall serve as its chairman. (d) The hearing panel shall, in closed session, hear the objections to the information of the parent and the testimony of the certificated employee who recorded the information in question, if any, and if such employee is presently employed by the school district. Written findings shall be made setting forth the facts and decisions of the panel, and such findings shall be forwarded to the superintendent or the governing board, depending upon who convened the panel.
