§ 48361 District Discretion Review Standard

Key Takeaways

  • •School districts can make their own decisions about how to run things.
  • •A court can only stop a school district's decision if it was really unfair or didn't make sense.
  • •The court has to say the school district acted in a very unreasonable way to change their decision.

Example

A school district decides to close a school because not enough kids are going there.

If some parents think this is unfair and take the school district to court, the court can only stop the closure if the school district's decision was really unreasonable, like they didn't think about it at all or made no sense.
