§ 35046 Retired Teacher Consultancy Contracts

Key Takeaways

  • •Schools can hire retired teachers as consultants if they worked for the school for at least 10 years and are at least 55 years old.
  • •The contract can be renewed every year for up to 5 years or until the retired teacher turns 65, whichever happens first.
  • •These retired teachers are still considered employees and have limits on how much they can earn.

Example

A teacher retires after working for a school district for 15 years. The school wants to hire them back as a consultant to help new teachers.

The school can do this because the teacher worked there for more than 10 years and is over 55. They can sign a contract that lasts up to 5 years or until the teacher turns 65. The teacher will still be treated as an employee with rules on how much they can earn.
