§ 24331 Beneficiary Designation For Unpaid Allowances

Key Takeaways

  • •If you get money from someone's retirement plan after they die, you can choose who gets any leftover money when you die.
  • •If the money goes to a trust, the person in charge of the trust can pick who gets the money next, unless the trust rules say otherwise.
  • •If the trust is fake or ends, the person getting the money can choose who gets it next, just like anyone else.

Example

Grandma's retirement money goes to her daughter after she passes away. The daughter can say who gets any leftover money when she dies.

The daughter is getting money from Grandma's retirement. She can pick her son to get any money left when she dies. If she puts the money in a trust, the person handling the trust can pick who gets it next, unless the trust papers say something different.
