§ 23852 Survivor Benefit Election

Key Takeaways

  • •If a worker dies and has no retirement plan set up, their spouse can choose to get all the money the worker put into retirement at once or get monthly payments if the worker qualifies.
  • •If there’s no spouse, the worker’s kids can get monthly payments instead of the lump sum, but only if the worker qualifies.
  • •If there’s no spouse or kids, the money the worker put into retirement goes to whoever they chose as their beneficiary in one big payment.
  • •The beneficiary can choose to give up their right to the money by filling out a form, but once they do, they can’t get the money later.

Example

A worker named John dies unexpectedly. He was saving money for retirement but hadn’t started taking it out yet.

John’s wife, Lisa, can choose to get all the money John saved for retirement at once, or if John qualifies, she can get smaller monthly payments instead. If John didn’t have a wife or kids, the money would go to whoever John picked as his beneficiary in one big payment.

(e) The payment of accumulated contributions in a lump sum shall include credited interest through the date of payment. (f) A beneficiary may waive the right to the lump-sum payment or survivor benefit allowance in accordance with the requirements established by the system. The waiver shall be submitted on a properly executed form prescribed by the system. The filing of a waiver by a beneficiary constitutes a complete and immediate discharge of all obligations of the board, the system, or the plan to, or on behalf of, the beneficiary.
