§ 21107 Spousal Trustee Powers After Death

Key Takeaways

  • •If a married person sets up a trust, they can let their spouse take over if they die.
  • •The surviving spouse can do everything the trust says the trustee can do.
  • •This includes managing the property and making decisions about the trust.

Example

A husband creates a trust for his family and puts his wife in charge if he passes away.

If the husband dies, his wife can manage the trust's property and make decisions just like he could when he was alive.
