§ 16526 School Construction Fund Approval

This law says the board must decide to approve or reject a school's request for construction money at their next meeting. If approved, the money is given but only becomes final if a vote passes later.

Key Takeaways

  • •The board must approve or reject the money request at their next meeting.
  • •If approved, the money is given but isn't final until a vote happens.
  • •The school has 9 months to get the vote done, or the money goes away.

Example

A school asks the state for money to build a new gym.

The board reviews the request and says 'yes' but the money isn't guaranteed until the school district votes to accept it. If the vote doesn't happen in 9 months, the money goes back to the state.

§ 16526 School Construction Fund Approval

At the next regular meeting of the board following the submission of the reports and recommendations required by Section 16525, the board shall, subject to this chapter, approve or reject the application. If the board approves the application, it shall by resolution adopted by it, apportion to the district from the State School Construction Fund the amount applied for, or any portion thereof that the board determines proper. This shall be known as a conditional apportionment and shall become final only if the vote provided for in Section 16527 is favorable. The conditional apportionment shall remain in effect for a period of nine months from the date of the resolution of the board. If the apportionment does not become final within the time prescribed, it shall become void and the money so apportioned shall again become available for apportionment pursuant to this chapter. (Added by Stats. 1996, Ch. 277, Sec. 2. Effective January 1, 1997. Operative January 1, 1998.)
