§ 16207 County School Building Aid

This law tells the county auditor to tell the school superintendent how much money is in the school building aid fund twice a year, and then the superintendent orders that money to be paid, but only up to $160 for each student who lives in a district that doesn’t take care of its own school buildings.

Key Takeaways

  • •The auditor must give the fund amount to the superintendent by the last Monday in December and the last Monday in May each year.
  • •The superintendent can order payment for the fund, but the total can’t be more than $160 for each student from districts that don’t maintain their own facilities.
  • •The money is paid to the state treasury and can only be used to repay the district that maintains the school buildings.

Example

A county has 500 students who live in districts that don’t maintain their own school buildings.

The auditor must tell the superintendent the fund amount by the last Monday in December and May. If the fund shows $90,000, the superintendent can only order up to $160 × 500 = $80,000 to be paid, because the law caps the payment at $160 per student. The money is then sent to the state’s school building aid fund and later used to pay back the district that actually maintains the schools.

The county auditor shall, not later than the last Monday in December and the last Monday in May of each year, notify the superintendent of schools of the amount in the county school building aid fund. Thereupon the superintendent shall draw his or her order on the county auditor in favor of the Treasurer for the amount in the county school building aid fund of the county, except that the total of the orders for any year may be limited to an amount not to exceed the total of one hundred sixty dollars ($160) for each unit of average daily attendance during the next preceding fiscal year of students residing in a district other than a district maintaining the facilities. The amount shall be paid by the county treasurer and, upon order of the Controller, shall be deposited in the State Treasury to the credit of the State School Building Aid Fund. All money paid to the State School Building Aid Fund under the provisions of this section shall be available only for transfer to the General Fund under Section 16403, as amended by Section 2 of Chapter 1373 of the Statutes of 1992, and shall be credited to the repayment of the apportionment of funds to the school district maintaining the facilities.
