§ 16062 School District Election Timing

This law lets a school district hold its election about money sharing either before or after the money amount is set, but it can’t be held within 45 days before or after a statewide election unless it’s run at the same time as that statewide election.

Key Takeaways

  • •School district elections about apportionments can be before or after the apportionment is made.
  • •They cannot be held within 45 days before or after a statewide election unless they are combined with that statewide election.
  • •The timing rules follow Part 3 of Division 10 of the Elections Code.

Example

A school district wants to vote on how to use a new state grant, and the next statewide election is on November 5.

The district can schedule its vote any day it likes, except it can’t pick a date like October 1 (which is 45 days before the November 5 election) or December 20 (which is 45 days after). If it wants to vote on those dates, it must hold the vote together with the November 5 statewide election.
