§ 16029 School Facility Modification Funding

This law lets school districts that already qualify for a repayment adjustment ask for extra money to fix existing school buildings for year‑round programs, but the extra money can’t be more than the cost of those fixes and is taken out of the amount they’d otherwise get.

Key Takeaways

  • •Districts can ask for extra funds to modify existing schools for continuous (year‑round) programs.
  • •The extra funds (apportionment) can’t exceed the cost of the modifications and can’t be more than what a new school would cost.
  • •Any apportionment given is subtracted from the eligible facilities cost before the state calculates the district’s repayment adjustment.

Example

A district wants to add a new wing to an existing elementary school so it can hold classes all year.

The district can apply for an apportionment (extra money) to pay for the wing, but the amount can’t be more than the cost of building the wing, and whatever they get will be subtracted from the repayment adjustment they would otherwise receive.

How to Calculate

Adjusted Eligible Cost = Eligible Facilities Cost – Apportionment

  1. Find the "eligible facilities cost" for the building changes (the total cost of the modifications).
  2. Determine the maximum apportionment – it cannot be more than the eligible facilities cost.
  3. Choose the actual apportionment amount (any amount up to the maximum).
  4. Subtract the apportionment from the eligible facilities cost to get the adjusted cost that will be used to compute the repayment adjustment.

The district estimates the wing will cost $500,000.

Result: Adjusted Eligible Cost = $500,000 – $200,000 = $300,000. The $200,000 apportionment is given to the district, and the remaining $300,000 is used in the repayment‑adjustment calculation.

§ 16029 School Facility Modification Funding

Notwithstanding any other provisions of this chapter, a school district qualifying for an adjustment of annual repayment obligations under Section 16025 or 15731 may apply for an apportionment under this chapter. The apportionment shall not exceed the “eligible facilities cost”, as defined in Section 16025 or 15731, and may be made available, upon the review and recommendation of the State Department of Education, only for the modifications of existing facilities necessary for the implementation of continuous school programs (as defined in Chapter 5 (commencing with Section 37600) of Part 22). In allocating funds under this chapter, the board may give first priority to school districts for modifications to existing facilities to be made pursuant to this section when in the judgment of the board the modifications of existing facilities are necessary for operation of year-round classes. In no event shall apportionments be made for modifications to a standard greater than could have been constructed in a new school building under this article. All of the provisions of the chapter apply to the districts except the provisions for the establishment of priorities. Any apportionment made under this section shall be deducted from the eligible facilities costs before the Director of General Services makes his or her computation of the adjustment under Section 16025 or 15731. (Repealed and added by Stats. 1996, Ch. 277, Sec. 2. Effective January 1, 1997. Operative January 1, 1998.)
