§ 10000 Personnel Exchange Agreements

This law lets California state universities, school districts, community college districts, and teacher‑training schools make agreements to swap teachers or staff for up to one year, and says the paying side must cover the salary or exchange staff.

Key Takeaways

  • •Agreements can be made for exchanging certified teachers or staff between universities, school districts, community colleges, and teacher‑training institutions.
  • •Assignments can be full‑time or part‑time but cannot last longer than one year.
  • •The entity receiving the staff must either pay the staff's salary and benefits or swap an equivalent staff member, and the employee stays on the original employer’s payroll.

Example

A community college sends one of its science teachers to work at a local high school for six months.

The high school and the college sign a contract that lets the teacher work at the high school. The high school either pays the teacher's salary or swaps one of its own teachers to the college. The teacher stays on the college's payroll the whole time.

(c) Any teacher-training institution in California may execute a contract with the governing board of any school district, or community college district, a county board of education, or the State Board of Education whereby certificated personnel of the institution may be assigned to school districts, community college districts, county boards of education, or the State Department of Education for full-time or part-time duty for a period not to exceed one year. (d) Any such contract shall provide for the payment, by the entity to which a person is assigned to the employer, of a sum equivalent to the salary and other employment costs of the employee.
