§ 8022 Merged Corporation Gift Transfers

• •If someone leaves money or property to a company in their will, and that company later merges with another company, the gift goes to the new combined company.
• •This rule applies to any kind of gift or promise mentioned in a will or other legal paper.
• •The gift still counts even if the company changes its name or structure after the merger.

A person writes in their will that they want to leave $10,000 to their favorite local charity. Later, that charity merges with a bigger charity.

The $10,000 will now go to the bigger charity that resulted from the merger, not to the original small charity.
