§ 5142 Charitable Trust Enforcement Actions

Key Takeaways

  • •If someone breaks the rules of a charity's trust, certain people can take action to fix it or get money for the harm done.
  • •People who can take action include the charity itself, its leaders, or someone who has a personal interest in the charity's assets.
  • •The Attorney General must be told about any action taken and can join in if they want.
  • •A court can stop a contract related to the charity only if everyone involved is part of the case, no one has already given something valuable without knowing about the trust rules, and it seems fair to do so.

Example

A charity is supposed to use its money to help sick kids, but the director starts using the money to pay for their own vacation.

A member of the charity or even the Attorney General can go to court to stop the director and make them pay back the money. The court can also stop any contracts the director made with the charity's money if it's fair and everyone involved is part of the case.
