§ 5005 Corporate Property Attachment Rules

Key Takeaways

  • •If a company owes money or is in a legal fight, its stuff (like money, buildings, or equipment) can be taken to pay what it owes.
  • •This rule applies to all companies just because they are companies—no exceptions.
  • •The stuff can be taken even before the court decides who is right or wrong in the fight.

Example

A small toy company doesn’t pay its supplier for plastic parts.

The supplier can ask the court to freeze the toy company’s bank account or take its machines until the company pays what it owes. This can happen even while the court is still figuring out the case.
