§ 25161 Incorporation By Reference

This law lets you reuse a document you filed before, as long as it was filed within the last four years and is still correct.

Key Takeaways

  • •You can attach an old document to a new filing instead of re‑filing it.
  • •The old document must have been filed no more than four years before the new filing.
  • •The document must still be correct and be available in the commissioner’s files.

Example

A homeowner filed a building permit three years ago and now wants to add a new deck. Instead of filing all the old paperwork again, they can just refer to the original permit in the new application.

Because the original permit was filed less than four years ago and is still accurate, the homeowner can attach it by reference to the new deck application.
