§ 25002 Security Advertisement Definition

This law tells us what counts as an “advertisement” when it’s used to sell a security.

Key Takeaways

  • •An advertisement includes anything written, printed, recorded on a phone, or spoken on radio, TV, or similar media.
  • •It only counts as an advertisement if it’s linked to offering or selling a security.
  • •The definition covers many ways people share messages, not just print ads.

Example

A company runs a TV commercial that says you can buy its new stock.

Because the commercial talks about buying the stock, it is considered an advertisement under this law.
