§ 3201 Negotiation Of Instruments

Key Takeaways

  • •Negotiation means giving a check or similar paper to someone else, whether you want to or not.
  • •If the check has a specific person's name on it, you need that person's signature to give it to someone else.
  • •If the check says 'pay to the holder' or something like that, you can just give it to someone else without a signature.

Example

You find a check on the ground made out to 'John Doe'.

You can't just give that check to your friend and expect them to cash it. John Doe has to sign the back of the check first. If the check just said 'pay to the holder', then you could give it to your friend without any signature.

§ 3201 Negotiation Of Instruments

(a) “Negotiation” means a transfer of possession, whether voluntary or involuntary, of an instrument by a person other than the issuer to a person who thereby becomes its holder. (b) Except for negotiation by a remitter, if an instrument is payable to an identified person, negotiation requires transfer of possession of the instrument and its indorsement by the holder. If an instrument is payable to bearer, it may be negotiated by transfer of possession alone. (Repealed and added by Stats. 1992, Ch. 914, Sec. 6. Effective January 1, 1993.)
