§ 11301 Payment Order Execution

This law explains when a bank has officially sent your money transfer and what day it counts as 'sent'.

Key Takeaways

  • •A bank 'executes' your money transfer when they send it to the next bank.
  • •The 'execution date' is the day the bank sends it, which can’t be before you asked.
  • •If you pick a payment date, the bank sends it early enough so the money arrives on time.

Example

You ask your bank to send $100 to your friend on Friday.

The bank must send it by Friday or earlier if needed so your friend gets it on time. If they send it on Thursday, that’s the 'execution date'.

§ 11301 Payment Order Execution

(a) A payment order is “executed” by the receiving bank when it issues a payment order intended to carry out the payment order received by the bank. A payment order received by the beneficiary’s bank can be accepted but cannot be executed. (b) “Execution date” of a payment order means the day on which the receiving bank may properly issue a payment order in execution of the sender’s order. The execution date may be determined by instruction of the sender but cannot be earlier than the day the order is received and, unless otherwise determined, is the day the order is received. If the sender’s instruction states a payment date, the execution date is the payment date or an earlier date on which execution is reasonably necessary to allow payment to the beneficiary on the payment date. (Added by Stats. 1990, Ch. 125, Sec. 2.)
