§ 9406 Contractor Affidavit Dispute Process

Key Takeaways

  • •If you disagree with a contractor's claim about money, you must write and send a counteraffidavit (a written statement) to the government explaining why you disagree.
  • •You must send this counteraffidavit within the time limit given by the government, and also send a copy to the contractor.
  • •If you don't send the counteraffidavit on time, the government will give the money to the contractor, and you can't complain later.
  • •The government doesn't check if the contractor's or your statement is true—they just follow the rules.

Example

A contractor says they didn't get paid for building a school playground and asks the city for money. You think they're lying because they already got paid.

You have to write a counteraffidavit to the city, explaining why the contractor is wrong, and send a copy to the contractor. If you don't do this on time, the city will give the money to the contractor, and you can't do anything about it.
