§ 8608 Payment Bond Claim Limits

Key Takeaways

  • •Only people who worked directly for the main contractor or through subcontractors can ask for money from the main contractor's payment bond.
  • •If you didn't work for the main contractor or their subcontractors, you can't get money from this bond.
  • •This rule doesn't change the rights of designers or people who have a secured interest in the property.

Example

A plumber works for a subcontractor on a big building project.

If the main contractor doesn't pay the subcontractor, the plumber can ask for money from the main contractor's payment bond because they worked through a subcontractor.
