§ 8484 Lien Release Petition Requirements

Key Takeaways

  • •If someone puts a lien on your property (like your house) and won’t remove it, you can ask a court to make them remove it.
  • •You must give the person who put the lien a warning first, asking them to remove it.
  • •You need to prove the lien is old or invalid, like showing the time to sue over it has passed.
  • •You have to include details like where the lien was filed and a copy of it when you ask the court for help.

Example

You sell your house, but an old contractor who worked on it years ago refuses to remove a lien, even though you paid them.

You can go to court and ask them to force the contractor to remove the lien. You’ll need to show proof you warned the contractor and that the time to sue over the lien has expired.
