§ 8464 Lien Enforcement Cost Recovery

Key Takeaways

  • •If you win a case about a lien (a legal claim on someone's property because they owe you money), you can get back the money you spent to file and check that lien.
  • •This applies whether you started the case or were defending yourself in it.
  • •This is extra money you can get on top of other costs the court might let you claim.

Example

You fixed someone's house, but they didn't pay you. You file a lien on their house and take them to court. You win the case.

The court will make them pay you back for the money you spent to file and check the lien, along with the money they owe you for the work.
