§ 8442 Lien Attachment To Property

Key Takeaways

  • •If you hire someone to fix or improve your property, they can put a lien on it if you don’t pay.
  • •Even if you didn’t hire them, you might still get a lien if you knew about the work and didn’t say you weren’t responsible.
  • •You can avoid a lien if you didn’t hire them by telling them officially that you’re not responsible.

Example

You own a house, and your tenant hires someone to fix the roof without telling you. You see the workers but don’t say anything.

If the roofer doesn’t get paid, they can put a lien on your house because you knew about the work and didn’t tell them you weren’t responsible.
