§ 8434 Contractor Lien Enforcement Limits

Key Takeaways

  • •If you're a main contractor or a subcontractor, you can only claim money for the work you did, not more.
  • •You have to subtract any money that other workers or subcontractors are owed for the same job.
  • •You can't ask for the full amount if others haven't been paid yet.

Example

A builder hires a plumber to fix pipes in a house. The builder also hires an electrician for the same house. The plumber finishes the job but hasn't been paid yet.

The plumber can only ask for the money he is owed for the pipe work, minus any money the electrician is still owed for his work. If the electrician is owed $500, the plumber has to subtract that from his total before asking for his payment.
