§ 8312 Lien Recording Deadline

Key Takeaways

  • •If you're a designer (like an architect or engineer) and you worked on a project that never started, you have 90 days to file a lien.
  • •A lien is like a legal 'I wasn't paid' note that can help you get your money later.
  • •You start counting the 90 days from when you find out the project isn't happening.

Example

An architect designs a new house for a client, but the client never starts building it and doesn't pay the architect.

The architect has 90 days from when they realize the house won't be built to file a lien. This lien helps them get paid later, even if the project is canceled.
