§ 6850 Association Penalty Notice Requirements

Key Takeaways

  • •If a group (like a homeowners association) can fine members for breaking rules, they must give everyone a list of the fines first.
  • •The fines can't be higher than what's on the list at the time the rule was broken.
  • •If the fines change, they must tell everyone about the changes.
  • •Anyone can ask for a copy of the latest fine list.

Example

You live in a neighborhood with rules, like no parking on the grass. The neighborhood group says they can fine people who break rules.

Before they can fine you for parking on the grass, they must give you a list of all the possible fines. If they later decide to fine you $50 for parking on the grass, that fine must be on the list they gave you earlier. If it's not on the list, they can't charge you.
