§ 5945 Tolling Enforcement Time Limits

Key Takeaways

  • •If you ask to solve a problem before time runs out to take legal action, the clock stops for a while.
  • •The clock stops first while the other side has time to answer your request.
  • •If they agree to work it out, the clock stays stopped while you try to fix the problem together.
  • •This gives people more time to solve problems without rushing to court.

Example

You have a problem with your neighbor’s fence, and you only have 30 days left to take them to court.

If you ask them to fix it on day 20, the 30-day clock stops while they think about it and while you both try to work it out. You won’t lose your chance to go to court just because you tried to fix it first.
