§ 5905 Association Dispute Resolution Procedure

Key Takeaways

  • •If you live in a community with rules (like a homeowners association), they must have a fair and quick way to solve problems between neighbors or with the association.
  • •They should use local programs with a neutral person (like a mediator) to help solve problems. These programs are often cheap or free.
  • •If the association doesn’t have a good way to solve problems, the state’s default rules (Section 5915) will be used instead.

Example

Your neighbor’s dog keeps barking all night, and you’ve asked them to stop, but they won’t. You complain to the homeowners association (HOA).

The HOA must have a fair and quick way to handle this problem. They might send you and your neighbor to a cheap mediation program to work it out with a neutral person. If the HOA doesn’t have a good way to solve this, the state’s rules will step in to make sure the problem gets fixed.
