§ 4705 U.S. Flag Display Rights

Key Takeaways

  • •You can display the American flag on your property or in your own space, like your balcony or window.
  • •The flag must be made of fabric, cloth, or paper and be on a pole or in a window—no flag paintings, lights, or decorations count.
  • •No one can stop you from putting up the flag unless it’s a safety issue, like blocking a fire escape.
  • •If someone tries to stop you and you win in court, they have to pay your lawyer fees.

Example

You live in an apartment and want to put an American flag on a pole outside your door.

Your apartment rules can’t stop you from putting up the flag as long as it’s a real flag on a pole and doesn’t cause any safety problems. If they try to stop you and you take them to court, they might have to pay your lawyer bills if you win.
