§ 3316 Freight Delivery Breach Value

Key Takeaways

  • •If a delivery company fails to deliver your stuff on time but didn’t steal it, they have to pay you for its value.
  • •The value is based on what the stuff was worth where and when it should have arrived.
  • •The delivery company can subtract the cost of shipping from what they owe you.

Example

You paid a trucking company to deliver your furniture to your new home, but they didn’t show up on the agreed date. They didn’t steal it; they just messed up the schedule.

The company has to pay you what the furniture was worth at your new home on the day it should have arrived. But they can take away the shipping fee you would have paid if they had delivered it on time.
