§ 2824 Indemnified Surety Liability

Key Takeaways

  • •If someone promises to pay your debt (like a friend covering your loan), they still have to pay even if the person you owe money to changes the deal or lets you off the hook.
  • •The person who promised to pay can't back out just because the deal changed or you were let go.
  • •This rule is about making sure the person who promised to pay keeps their word, no matter what.

Example

Your friend promises the bank they'll pay your car loan if you can't. Later, the bank says you don't have to pay the loan anymore, but your friend still has to pay what they promised.

Even though the bank let you off the hook, your friend still has to pay because they promised to cover your debt.
