§ 2080 Lost Property Depositary Duties

If you find something that belongs to someone else, you don’t have to keep it unless you’re already required to, but if you do take it, you become a caretaker for the owner and must tell them and give it back without charging, except for a fair fee for taking care of it. You also must treat any live pet you find humanely.

Key Takeaways

  • •You’re not forced to keep found items unless a contract or other law says you must.
  • •If you take possession, you become a caretaker and must notify the owner and return the item, only charging a reasonable fee for care.
  • •If the found item is a live domestic animal, you must treat it humanely.

Example

You find a neighbor’s lost dog tied up on the street, bring it home, feed and water it, then call the neighbor to let them know where it is and return the dog, only asking for a small charge to cover food and care.

Because you took possession of the dog, the law treats you like a caretaker. You must let the owner know where the dog is, give it back, and you can only charge a reasonable amount for the food and care you provided.

§ 2080 Lost Property Depositary Duties

Any person who finds a thing lost is not bound to take charge of it, unless the person is otherwise required to do so by contract or law, but when the person does take charge of it he or she is thenceforward a depositary for the owner, with the rights and obligations of a depositary for hire. Any person or any public or private entity that finds and takes possession of any money, goods, things in action, or other personal property, or saves any domestic animal from harm, neglect, drowning, or starvation, shall, within a reasonable time, inform the owner, if known, and make restitution without compensation, except a reasonable charge for saving and taking care of the property. Any person who takes possession of a live domestic animal shall provide for humane treatment of the animal. (Amended by Stats. 1998, Ch. 752, Sec. 9. Effective January 1, 1999.)
