§ 92 Pleadings And Motion Limits

Key Takeaways

  • •You can only use certain papers in court: complaints, answers, cross-complaints, answers to cross-complaints, and general demurrers.
  • •You don’t have to swear that your answer is true, even if the other person did for their complaint.
  • •You can’t use special demurrers (a type of legal argument).
  • •You can only ask to remove something from the case if the complaint doesn’t match what they’re asking for.

Example

If someone sues you for breaking a contract, you can write an answer to explain your side, but you don’t have to promise it’s 100% true like they might have done.

The law says you don’t need to verify (swear) your answer is true, even if the other person did for their complaint.
